Privacy Policy
How we collect, use and protect the personal information you share with us, whether you book a table, send us an enquiry, join our mailing list or simply browse the site.
About this policy
NOLA Eatery & Bar (“NOLA”, “we”, “us”, “our”) operates the restaurant at 1161 Queen St East in Leslieville, Toronto, and the website at nolaeateryandbar.com.
We respect your privacy. This policy explains what personal information we collect when you visit our website, book a table, contact us or dine with us, how we use it, who we share it with, and the choices you have.
We handle personal information in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy law.
What this policy covers
This policy applies to nolaeateryandbar.com and to personal information we collect through the site, by phone, by email and in the restaurant.
It does not apply to third-party services that operate under their own privacy policies, including our reservation platforms, payment processors, delivery partners and social media platforms. When you leave our site to use one of those services, that company’s privacy policy governs the information you give them. We explain this further in section 6.
Information we collect
Information you give us directly
- Reservation details. Your name, phone number, email address, party size, date and time, seating preference, and any notes you add, such as an allergy, dietary restriction or occasion.
- Enquiries and event bookings. Information you provide through our contact forms, by email or by phone when you ask about private dining, group bookings, catering or an event.
- Marketing sign-ups. Your name and email address if you subscribe to our newsletter or offers list.
- Gift cards and online orders. Recipient details and order information, where applicable.
- Reviews and feedback. Comments and ratings you send us directly, or post publicly on platforms such as Google, OpenTable or Instagram.
- Job applications. Your resume, cover letter and contact details if you apply for a role with us.
Information collected automatically
When you visit our website, we and our service providers may collect:
- IP address and approximate location, usually at city level
- Browser type and version, device type and operating system
- Pages viewed, time on page, referring URL and links clicked
- Date and time of your visit
- Cookie and similar identifiers
This is standard website analytics data. It helps us understand which pages people find useful and where the site is not working well.
Information from third parties
We may receive information about you from:
- Reservation platforms such as OpenTable and Resy, when you book a table through them
- Delivery and ordering partners, when you place an order for pickup or delivery
- Payment processors, who confirm a transaction succeeded without passing us your full card details
- Social media platforms, when you interact with our pages or tag us
- Review sites, where feedback is publicly posted
How we use your information
We use personal information to:
- Confirm, manage and honour your reservation, including seating preferences and allergy or dietary notes
- Contact you about a booking, a change or a cancellation
- Answer your questions about the menu, hours, private dining or events
- Process and fulfil orders, gift cards and payments
- Send you offers, event invitations and news, where you have asked to receive them
- Improve our menu, service and website based on aggregated feedback and analytics
- Understand how people find and use our site, so we can make it better
- Meet our legal, accounting and health and safety obligations
- Detect and prevent fraud, no-show abuse and misuse of our site
We do not sell your personal information.
Consent
In most cases we collect personal information with your knowledge and consent. You give consent when you fill in a booking form, join our mailing list or send us an enquiry.
We may collect, use or disclose information without consent where the law permits or requires it, for example to investigate a breach of an agreement, to comply with a court order, or in an emergency that threatens someone’s life, health or security.
You can withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. Withdrawing consent may mean we can no longer provide a particular service, such as holding a reservation.
Reservations and third-party platforms
Our online booking is handled by third-party reservation platforms. When you click a “Reserve” or “Book a table” link on our website, you are taken to that platform’s own booking flow, and the information you enter there is collected by them under their privacy policy, not ours.
We receive the booking details they pass back to us so we can hold your table and prepare for your visit.
We encourage you to read their privacy policies:
- OpenTable: opentable.ca/legal/privacy-policy
- Resy: resy.com/privacy
Cookies and similar technologies
Our website uses cookies and similar technologies. A cookie is a small text file placed on your device that helps a site remember your preferences and understand how it is used.
We use:
- Essential cookies, which are needed for the site to function
- Analytics cookies, which tell us how visitors use the site in aggregate
- Marketing and advertising cookies, which may be set by platforms such as Meta or Google so we can measure and target advertising
You can control cookies through your browser settings, including blocking or deleting them. If you block essential cookies, parts of the site may not work as intended.
Our site does not currently respond to browser “Do Not Track” signals, as there is no common standard for how they should be handled.
Email marketing
If you subscribe to our list, we will send you occasional emails about menu changes, wine nights, seasonal offers and events.
Every marketing email includes an unsubscribe link, and we honour those requests promptly. This is consistent with Canada’s Anti-Spam Legislation (CASL). Unsubscribing from marketing does not stop transactional messages, such as a reservation confirmation.
Who we share information with
We share personal information only as needed, and only with:
- Service providers who work on our behalf, including our reservation platform, website host, email marketing provider, analytics provider, payment processor and delivery partners. They may only use the information for the services they provide to us.
- Professional advisors, such as accountants and lawyers, where necessary.
- Authorities, where we are required by law, court order or regulation to disclose information.
- A successor organisation, if our business is sold or reorganised, subject to appropriate privacy protections.
Payments
We do not store full payment card numbers. Card payments in the restaurant and online are processed by PCI-compliant payment providers. We may retain a record of the transaction, including the amount, date and last four digits of the card, for accounting purposes.
Some reservations, particularly large parties and private events, may require a card on file or a deposit through our reservation platform. That card information is held by the platform, not by us.
Storage, transfers and location
Some of our service providers store or process information on servers located outside Canada, including in the United States. Where that happens, the information may be accessible to law enforcement and national security authorities of that country under its laws.
We take reasonable steps, including contractual protections, to require our providers to protect personal information to a standard comparable to Canadian law.
How long we keep information
We keep personal information only as long as we need it for the purpose it was collected, or as long as the law requires. As a general guide:
- Reservation records are retained for a limited period to manage bookings, resolve disputes and recognise returning guests
- Enquiry and event correspondence is retained while the enquiry is active and for a reasonable period afterwards
- Marketing subscriptions are retained until you unsubscribe
- Financial and transaction records are retained for the period required by tax and accounting law
- Job applications are retained for a limited period, unless you ask us to remove them sooner
Security
We use reasonable physical, organisational and technical safeguards to protect personal information against loss, theft and unauthorised access, disclosure or alteration. These include restricted staff access, secure hosting and encrypted transmission of data submitted through our site.
No method of transmission or storage is completely secure. We cannot guarantee absolute security, but we take our responsibility here seriously and review our practices regularly.
Your rights and choices
Subject to legal limits, you have the right to:
- Access the personal information we hold about you and be told how it has been used and disclosed
- Correct information that is inaccurate or incomplete
- Withdraw consent to marketing or to other uses of your information
- Ask us to delete information, where we are not required to keep it
- Complain about how we have handled your information
To exercise any of these rights, contact us using the details in section 18. We will respond within the time required by law, normally 30 days. We may need to verify your identity before acting on a request.
If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada at priv.gc.ca or 1-800-282-1376.
Children
Our website and services are intended for a general audience and are not directed at children. We do not knowingly collect personal information from children without parental consent. Families are very welcome in the restaurant, and where a parent or guardian books on a child’s behalf, we treat any details provided as the parent’s or guardian’s information.
Links to other websites
Our site links to third-party sites, including reservation platforms, delivery partners, review sites and social media. We are not responsible for the privacy practices or content of those sites. We encourage you to read their policies before providing personal information.
Changes to this policy
We may update this policy from time to time to reflect changes in our practices, technology or the law. The revised version will be posted on this page with a new “Last updated” date. Significant changes will be brought to your attention where appropriate. Continued use of our website after an update means you accept the revised policy.
